Introduction:

This privacy policy (“Policy”) informs you of your choices and our practices in relation to your Information (as defined below). In this Policy, “Applicate Apps”, “we” or “us” refers to Applicate Private Limited, a company registered in Pakistan with its office located at 189 Korang Road, I-10/3, Islamabad, Pakistan. We choose why we need to use your Information and how it is used, which means we are considered the data controller in certain countries. For this Policy, “Information” means any information relating to an identified or identifiable individual. This includes Information relating to your use of our mobile games (“Mobile Games” or “Games”). When you use the Mobile Games or our Website, you accept our rules and policies which set out how we handle your Information, and you understand we collect, process, use and store your Information as described in this Policy. If you do not agree with this Policy, you must not play any of the Games. If you change your mind in the future, you must stop playing the Games and you may exercise your rights in relation to your Information as set out in this Policy.

When you reach out for support, we may request details you choose to provide, such as your device brand and model, advertising ID, transaction history, or device language. This information helps us assist you more effectively and resolve your inquiries.

When you play our games, we automatically collect or generate data about your gameplay experience. This may include device information, gameplay activity, in-game interactions, IP address, and other technical data that help us optimize performance, enhance features, and improve your overall gaming experience.

a. We use cookies and similar technologies (e.g., web beacons, log files, scripts) to enhance your gaming experience. These small files, when placed on your device, enable various features and improve functionality. You have control over cookie settings—you can allow their installation, receive notifications before they are set, or disable them entirely through your device or browser settings. However, disabling cookies may affect game performance and limit certain features.

b. We collect various identifiers to enhance your gaming experience and improve our services. This includes your IP address, advertising ID, HTTP headers, MAC address, device ID, country and city-level location data, and device details such as model, brand, language, and operating system.

c. Information regarding your use of the Games: game ID, install and uninstall timestamps, date and time stamps of game events, game time, advertising and promotions engagement, transaction records.

Information received from third parties

a. We receive data from third-party partners to evaluate the effectiveness of our marketing campaigns and detect fraudulent activities. This information may include your advertising ID, IP address, location, and transaction

b. Payment providers: When you make payments in our Games, we receive the following Information from our payment providers about your transactions: transaction ID, country, payment provider used, purchased item, currency, value, and payment timestamp.

d. We receive information from third-party advertising providers, including your user ID and details about your interactions with ads displayed in our mobile games. This helps us optimize ad performance and improve your in-game experience.

Children's Privacy

Our Games are not for children under the age of 13, and Applicate Gaming acts deliberately so it does not collect or process Personally Identifiable Data from children under the age of 13. If you are a parent or guardian of a child who is under the age of 13 (or under the age of 16 in some countries and regions of the European Union) and using our games, we kindly ask that you contact us at contact@applicatetech.com. We will erase your child’s identifiable personal data except where you certify that your child will continue to play our games.

Enhancing Your Gaming Experience. We use your information to fulfill our contractual obligations, ensuring seamless access to our games. Additionally, we process your data to enable in-game purchases via Google Play and the iOS App Store while maintaining transaction records. This includes your identifiers, gameplay data, in-game interactions, and other relevant information that enhances your overall gaming experience.

Enhancing and Monitoring Game Performance. We have a legitimate interest in improving our games for our players. To achieve this, we may automatically collect or generate information about your gameplay experience, along with details about your device, including battery level, Wi-Fi strength, manufacturer, model, operating system, and available storage space.

Providing Support and Addressing Your Request. We use your information to assist you, respond to inquiries, and resolve any issues or complaints. If you contact us for support, we will create a support account, facilitate assistance, and address your concerns as part of our contractual obligation to you. The information we process for this purpose includes your registration details, identifiers, device information (such as Wi-Fi strength and available storage), and any additional data collected through our customer support channels.

Sending In-Game Offer Updates. We display promotional offers and information about virtual items available for purchase in-game, tailored to your experience based on factors such as gameplay activity, location, device data, and in-game interactions. This is done in accordance with our legitimate interest in enhancing user engagement.

Providing Advertising. We display ads and recommendations within our games and other platforms, including promotions for our own games and services you may find relevant. These ads may be personalized based on your interests. Where required, we will seek your consent before showing targeted ads. In cases where consent is not necessary or when providing contextual advertising, we rely on our legitimate interests. If you wish to stop receiving targeted ads, you can withdraw your consent in the game settings. To personalize ads, we process information automatically collected or generated during gameplay, as well as data received from third-party partners.

Cloud service providers who rely on for data storage, including Amazon Web Services.

Customer support solution providers, who help us manage and respond to our customer questions and complaints. This includes Zendesk Inc., who are based in the U.S.

User acquisition. We work with a variety of user acquisition partners to help us report on the success of our marketing campaigns. We may use some of your Information to participate in Custom Audience and Lookalike Audience programs, which enable us to display adverts to both existing and prospective supporters when they visit one of our partners’ websites. We may provide an identifier (i.e. your Advertising ID or Facebook ID) to them so they can determine whether you are a registered account holder with them. Advertising partners. We are an ad-supported service. Subject to your settings, we provide certain Information to advertisers who will use them to serve you with ads in our Games, and we measure who sees and clicks on their ads. We also share advertising identifiers, along with the interests or other characteristics of a device or the person using it, to help partners decide whether to serve an ad to that device or to enable them to conduct marketing, brand analysis, personalize advertising, or similar activities. Payment processors: For Mobile Games, we use payment processors such as Google (if you run Android on your mobile device), Apple App Store payments (if you run IOS on your mobile device). These payment processors are responsible for the processing of your Information, and may use your Information for their own purposes in accordance with their privacy policies as below:

Companies who belong to the same group as Applicate. We share your Information with different entities which are part of our group of companies.

Law enforcement agencies, public authorities or other judicial bodies and organizations. We disclose Information if we are legally required to do so, or if we have a good faith belief that such use is reasonably necessary to comply with a legal obligation, process or request; enforce our terms of service and other agreements, policies, and standards, including investigation of any potential violation thereof; detect, prevent or otherwise address security, fraud or technical issues; or protect the rights, property or safety of us, our users, a third party or the public as required or permitted by law (including exchanging information with other companies and organizations for the purposes of fraud protection).

Change of corporate ownership. If we are involved in a merger, acquisition, bankruptcy, reorganization, partnership, asset sale or other transaction, we may disclose your Information as part of that transaction.

If you access our games through a third-party platform such as Apple or Google (“Third-Party Services”), please be aware that these services may collect additional information about you, including data you share with them directly or information about your use of the games, in accordance with their own terms and privacy policies. The privacy practices outlined in this Policy do not apply to Third-Party Services. Additionally, any links to Third-Party Services within our games do not imply endorsement or review by us.

Data Security

Although we have in place security measures to maintain the privacy and integrity of your Information, unfortunately, the transmission of Information via the internet is not completely secure. We may also take extra steps to protect your Information and minimize the Information we process.

4. Locations Where We Process Your Personal Information

We process your information in multiple countries, including those within the European Economic Area (EEA), the United Kingdom (UK), the United States, and others. When transferring your information outside the UK or EEA, we may transfer it to countries recognized as providing adequate protection by the EEA or UK. If a country does not have this adequacy status, we implement standard contractual clauses approved for use in the EEA and UK to ensure your information remains protected during the transfer.

5. Retention Period for Your Information

We retain your information for as long as you are registered or actively using our games, and for up to three years after your last interaction with them. When deleting information, we take steps to ensure it is irrecoverable or irreproducible, and any electronic files containing your data will be permanently deleted.

You have the right to access your information and receive details on how we use it and with whom we share it. However, this right is not absolute. For instance, we cannot disclose trade secrets or provide information about other individuals.

You have the right to request the deletion of your information. However, in certain cases, we may need to retain some data in accordance with data protection laws, such as for legal defense, freedom of expression, or other overriding legitimate interests. If this applies, we will inform you. If your information is held by a third-party data controller, such as an advertising partner or payment processor, we will take reasonable steps to notify them of your request. However, we recommend contacting them directly through their privacy policies to ensure your data is deleted.

You have the right to: (i) withdraw your consent if you previously provided it, or (ii) object to the processing of your information when it is based on our legitimate interests (see How We Use Your Personal Information above). You may exercise it as given below:

To stop receiving personalized advertising: for Mobile Games, please withdraw your consent in the in-app Settings.

To stop receiving push notifications: please change your device settings.

You have the right to request the correction of any inaccurate information we hold about you.

In certain circumstances, you have the right to restrict our processing of your information, allowing us to store it but not use it for other purposes.

The provisions of this Appendix apply to California residents under the California Consumer Privacy Act of 2018 (California Civil Code §§ 1798.200 to 1798.199) and its related regulations, as amended or updated (“CCPA”). Internet or other electronic network activity information, including your use of in-game features and events and information on your in-game activity, and information on your interactions with advertising shown in on our Games. Geolocation data, including city level location data. This information is collected directly from you or your device and from third party services when you register through them.

Commercial information, including records of products or services purchased, obtained, or considered, your Apple ID number for Apple, your postcode and state for Google. This information is collected directly from you or your device.

Over the past twelve months, we have gathered Personal Information from the following sources:

You can opt out and manage these technologies at any time through the Privacy Settings or, for certain mobile games, by adjusting the in-app settings. CCPA:

Under the CCPA, California residents are granted specific legal rights, though these rights are subject to certain exemptions. If you are a California resident and no applicable exemption applies to you or your personal information, you have the right to:

Submit a verified request to access the following information from the past 12 months:

the categories of Personal Information about you that we collected, sold, or disclosed;

We aim to fulfil all verified requests within 45 days pursuant to the CCPA. If necessary, extensions for an additional 45 days will be accompanied by an explanation for the delay.

We do not rent, sell, or share Personal Information with non-affiliated companies for their direct marketing purposes under California’s “Shine the Light” law (Civil Code § 1798.83), unless you give us your consent.
